Why Probate and Trust Real Estate
Requires a Different Approach

Probate and trust real estate sales are rarely ordinary transactions. They often involve legal timelines, family emotions, fiduciary responsibilities, property condition issues, and important decisions that need to be handled carefully

In these situations, the real estate professional must bring more than marketing experience. The process requires patience, organization, communication, compassion, documentation, and respect for the attorney-client relationship.

Common issues may include:

Grief

Many clients are coping with the loss of a loved one while also being asked to make important financial and property decisions. The process requires patience, care, and sensitivity.

Family pressure

Family members may have different opinions on timing, pricing, repairs, personal property, or whether the home should be sold at all. Clear communication helps reduce confusion and unnecessary conflict.

Court timelines

Some probate matters may involve court procedures, required notices, confirmation hearings, filing deadlines, or timing considerations that can impact the sale process. It is important for the real estate transaction to be organized in accordance with the attorney's guidance and any applicable legal requirements to help prevent unnecessary delays.

Trustee responsibilities

Successor trustees must act carefully and responsibly for the benefit of the trust and its beneficiaries. They often require clear, well-documented, and practical real estate guidance.

Executors and administrators

Executors, administrators, and personal representatives often handle estates for the first time. They frequently need assistance understanding the real estate process, preparing the property, reviewing offers, and navigating through escrow.

Deferred maintenance

Estate properties often require extensive maintenance, have outdated systems, and may involve repairs or safety issues. The optimal strategy depends on the property's condition, the estate's goals, the current market, and the resources available to the client.

Personal Property

Homes may still have furniture, personal belongings, vehicles, records, or items of emotional significance. Clean-out and preparation should be conducted respectfully and, when appropriate, in coordination with the client and attorney.

Occupants

Some properties may be occupied by family members, tenants, caregivers, or others. Issues related to occupancy require careful communication and should be addressed with appropriate professional and legal guidance.

Disclosures

Sales involving probate and trusts must be handled with great care regarding real estate disclosures. Since the client may have limited knowledge of the property, it is essential to approach the process thoughtfully and ensure proper documentation is in place.

Title issues

Estate-related sales can raise questions about ownership, titles, deeds, easements, and liens. It's crucial to coordinate these matters with attorneys, escrow agents, title companies, and other relevant professionals.

Escrow coordination

Escrow may require additional documents, signatures, authority verification, court-related information, trust documentation, and communication among multiple parties. Organization and follow-up are essential.

Multiple heirs or beneficiaries

When multiple heirs or beneficiaries are involved, communication can be more delicate. The real estate professional must remain neutral, professional, and transaction-focused while also respecting the attorney’s role.

These matters typically involve real estate and legal considerations; therefore, the process benefits from a calm, experienced, and organized real estate professional who understands the importance of communication, documentation, and client care.

Client Testimonials From Successor Trsutees

Successor Trustee

Dear Future Home Seller:

I'm writing this letter to highly recommend Charles Mortimer for your real estate needs. My mother passed away this past summer, and as the successor trustee, it was my responsibility to put the house on the market for sale. Charles came recommended by my attorney to assist with the sale. This, by far, was the best decision I made for my realtor needs.

What I loved the best was that throughout my home-selling process, Charles was incredibly communicative. He promptly answered calls and emails, keeping me informed about every development. I never felt that he was just trying to sell my house, but that he was a mentor to answer my questions during this process, especially since the home was in a trust. His dedication, expertise in selling a home in a trust, and friendly approach made my home-selling experience enjoyable.

Charles's insight was extremely valuable, and I don't think I could have done this without him. He was incredibly efficient and handled all the complexities of selling my home with ease. His attention to detail ensured that every part of the process was seamless and stress-free. It’s his superb work that allows me to recommend Charles Mortimer and his services to you with confidence. Best Regards,

Janice F.

Successor Trustee

As the sole trustee for my late aunt's estate, I was referred to Charles Mortimer by my aunt's lawyer. We first met Charles on January 6, 2024, at my late aunt's house in San Lorenzo. The house closed on February 16, 2024, just some 42 days after we first met Charles.

He was the only agent we interviewed. Charles was able to secure a cash offer, which was accepted in one day after going on the market with five offers, closed in seven days, and was 81k above the listing price.

Charles was always available for my multitudinous questions. He is polite to a fault and is the quintessential English gentleman.

I am very grateful to Charles for the successful conclusion of this significant piece of my aunt's trust. Good show, old boy!" Paul S.

Successor Trustee

With most Realtors, when I interview them, it is all about them; it is all about what "they" can get the most for themselves from selling my property.

With Charles, when I interview him, it is all about me; it is all about what he can get the most for "me" from selling my property. Charles is the most ethical and transparent Realtor I have worked with.

Charles is a true gentleman who actually says what he means and means what he says.

When I contracted with other agents, they mostly acted as if they owned my property and me; they subtly took over my role, as owner and seller of my property; ceaselessly pushing me, as a Trustee, to spend tens of thousands of dollars on renovations before listing my property, which I refused to do, and therefore, I ended their contract.

When I contracted with Charles, he never acted as if he owned my property or me; he always supported and guided my role as owner and seller of my property, gently reminding me, as a Trustee, to spend the least amount of money on renovations before listing my property.

With Charles, he worked so hard behind the scenes that my property sold: At almost $200K over the asking price, with over 10 offers; in less than 6 weeks, from the day it listed on the MLS to the close of escrow.

You need not take my word for it: Experience Charles' professionalism and expertise for yourself.
